1. Definitions
​
We/Us: True Spirit Entertainment, seller and/or lessor.
Customer: Any person or entity purchasing products or services from us.
Products: Digital items (e.g., films, e-books), physical goods (e.g., books, merchandise), and rental items (equipment).
Rental: Temporary provision of equipment for a daily fee.
2. Applicability

These Terms apply to all quotations, orders, sales, rentals, and deliveries unless agreed otherwise in writing. Any customer terms are expressly rejected.
3. Prices & Taxes
​
Prices are shown in EUR and include VAT where applicable.
We may correct obvious errors (e.g., pricing/stock).
If you were already charged, you will be refunded.
4. Ordering & Payment
​
Payment is captured at checkout or upon invoice (unless otherwise agreed).
We may refuse or cancel orders in case of suspected fraud, errors, or availability issues.
An invoice and/or payment receipt is issued electronically.
5. Delivery & Risk
​
Digital items: Delivered instantly via download/streaming after payment.
Physical goods: Shipped to the address provided; risk passes upon delivery. Delivery times are estimates. Any duties/import taxes are the customer’s responsibility.
Rental pickup/return: Times and location as agreed.
6. Right of Withdrawal (Consumers)
​
Physical goods: 14-day return period from delivery. Items must be unused and in original packaging (including all accessories). Return shipping is paid by the customer unless the item is defective or we made an error. Refunds are processed after inspection.
Digital content: No right of withdrawal once delivery has begun and you have expressly consented to immediate delivery and acknowledged loss of the right of withdrawal at checkout.
Exclusions: Custom items and used/damaged/incomplete returns may be refused or partially refunded.
B2B: No statutory right of withdrawal unless agreed in writing.
7. Rental Terms (Equipment)
​
Daily rate: Rentals are billed per calendar day.
Return deadline: Return by the agreed due date/time. Each extra late day will be charged at the daily rate (plus any reasonable surcharge if stated).
Care & use: Handle, operate, and transport equipment safely and lawfully; normal wear excepted.
Damage/loss: Damage, loss, or missing parts may be billed at repair or replacement cost.
Deposit/ID: A refundable deposit and/or ID verification may be required; unpaid charges and damage may be set off against the deposit.
Sub-rental: No sub-rental or transfer without our written consent.
8. Conformity & Warranty

We deliver in accordance with the agreement. Statutory conformity applies to physical goods.
No warranty for wear-and-tear, misuse, or improper handling.
Report defects within a reasonable time.
9. License & IP (Digital Content)
​
All intellectual property remains with us or our licensors.
Digital content is licensed for personal, non-transferable use.
Copying, redistribution, resale, or public performance is prohibited without permission.
10. Liability
​
To the fullest extent permitted by law, our total liability is limited to the amount you paid for the relevant order.
We are not liable for indirect or consequential damages.
This does not limit liability where such limitation would be unlawful.
11. Privacy
​
We process personal data according to our Privacy Policy (GDPR compliant).
Marketing emails are sent only with opt-in; you can unsubscribe at any time.
12. Force Majeure
​
In case of force majeure (e.g., outages, strikes, epidemics, fire, logistics issues, governmental measures) we may suspend obligations or terminate the agreement without liability.
13. Complaints
​
Email info@truespiritentertainment.com with your order number and details.
We will respond promptly and work to resolve issues quickly.
14. Changes
​
We may update these Terms. The latest version applies to new orders; see the version date above.
15. Governing Law & Jurisdiction
​
These Terms are governed by Dutch law.
Exclusive jurisdiction lies with the competent courts in Arnhem/Leeuwarden, The Netherlands (and, where applicable on appeal, the Arnhem-Leeuwarden Court of Appeal).
